Who Can Vote  

According to Section 17 of the Municipal Elections Act 1996 

You are eligible to vote in the 2022 Municipal Election, if on Voting Day (Monday, October 24, 2022), you: 

• Resident of East Hawkesbury, or are the owner or tenant of land in East Hawkesbury or the spouse of such owner or tenant 
• Are a Canadian Citizen 

• Are at least 18 years old 

Voting method

Eligible electors will be able to vote by internet from October 19 to 24, 2022.

The following are prohibited from voting: 

• A person who is serving a sentence of imprisonment in a penal or correctional institution 
• A corporation 

• A person acting as executor or trustee or in any other representative capacity, except as a voting proxy in accordance with section 44. 
• A person who was convicted of the corrupt practice described in subsection 90 (3), if voting day in the current election is less than five years after voting day in the election in respect of which he or she was convicted.  

School Board Voters: 

English Public Voter must: 

• be a supporter of the English-language public district school board; or 

• not be a supporter of any board, nor have qualified him- or herself as an elector for a separate or French-language school board in the election. 

English Separate Voter must: 

• be a Roman Catholic who must: 

• qualify as an elector for the English-language separate district school board; or 
• be a supporter (or be the spouse of a supporter) of the English-language separate district school board. 

French Public Voter must: 

• be a French-language rights holder (see ss. 23(1) and (2) of the Canadian Charter of Rights and Freedoms for criteria) who must: 

• qualify as an elector for the French-language public district school board; or 
• be a supporter (or the spouse of a supporter) of the French-language public district school board. 

French Separate Voter must: 

• be a Roman Catholic and 
• a French-language rights holder (see the Charter for criteria) who must: 

• qualify as an elector for the French-language separate district school board; or 
• be a supporter (or the spouse of a supporter) of the French-language separate district school board. 

2022 Municipal Elections Joint Compliance Audit Committee

Municipalities located within the United Counties of Prescott and Russell are recruiting experienced professionals for appointment to their 2022 Municipal Elections Joint Compliance Audit Committee.

The Committee is independent of the municipalities and is required by the Municipal Elections Act, 1996 to consider applications requesting audits of candidates' campaign finances. Committees may be required to appoint auditors and determine if legal proceedings are required as a result of the auditors' reports.

Applicants with a background in accounting, auditing, law, election administration, and/or public administration are preferred. Applicants should:

• have an understanding of municipal campaign finance provisions;
• demonstrate analytical decision-making and excellent communication skills;
• have experience working with or as a member of government boards, task forces and/or quasi-judicial bodies; and
• have flexibility to attend meetings during daytime and evening hours.

Applicants cannot be candidates in the 2022 Municipal Election, nor can they have committed to providing professional advice to any person running for office in any municipality located within the United Counties of Prescott and Russell. Applicants also cannot be Members of Council or current employees of any municipality located within the United Counties of Prescott and Russell.

The Committee's term of office is four years, beginning on November 15, 2022. Successful applicants will receive a retainer of $400 and a per diem of $100 (plus mileage).

Becoming a Candidate 

If a person wishes to run as a candidate in the Township of East Hawkesbury municipal election, they must:

• File nomination Form 1 with the Township Clerk.
• Have a valid proof of identity
• Filing fee of $200.00 for the Head of Council and $100.00 for all other offices.

The first day to file nomination forms for the next municipal election will be Monday, May 2nd, 2022 and the deadline for submission is on  Friday, August 19th, 2022 during normal office hours 

Offices to be Elected 

The following offices will be elected in the 2022 Municipal Election: 

Mayor:

• one (1) to be elected by all voters of the municipality  

Deputy Mayor:

• one (1) to be elected by all voters of the municipality  

Township Councillors:    

• three (3) to be elected by all voters of the municipality  

School Board Trustees:

The number of trustees for each of the following school boards will be determined in the spring of 2022: 

• Upper Canada District School Board 

• Catholic District School Board of Eastern Ontario 
• Conseil des Écoles Publiques de l’Est de l’Ontario 
• Conseil Scolaire de District Catholique de l’Est Ontarien

The term of office: November 15, 2022 and end on November 14th, 2026.

Unofficial list of Candidates for School Board Trustee

Council Member Qualifications 

Sections 256 and 257 of the Municipal Act, 2001 state: 

256. Every person is qualified to be elected or to hold office as a member of a council of a local municipality,
257. a) who is entitled to be an elector in the local municipality undersection 17 of the Municipal Elections Act, 1996;and 
258. b) who is not disqualified by this or any other Act from holding the
259. Every person is qualified to be elected or to hold office as a member of a council of an upper-tier municipality,
260. c) who is entitled to be an elector in a lower-tier municipality within the upper-tier municipality under section 17 of the Municipal Elections Act, 1996;and
261. d) who is not disqualified bythis or any other Act from holding the  

Disqualification of a Member of Council 

Section 258 of the Municipal Act, 2001 states: 

Ineligible  

258. (1) The following are not eligible to be elected as a member of a council or to hold office as a member of a council:

1.Except in accordance with section 30 of the Municipal Elections Act, 1996, as follows: 

1. an employee of the municipality,
2. a person who is not an employee of the municipality but who is the clerk, treasurer, Integrity Commissioner, Auditor General,Ombudsmanor registrar referred to in section 223.11 or an investigator referred to in subsection 239.2 (1) of the municipality, or 

iii. a person who is not an employee of the municipality but who holds any administrative position of the municipality.

2. A judge of any court.
3. A member of the Assembly as provided in the Legislative Assembly Act or of the Senate or House of Commons of Canada.
4. Except in accordance with Part V of the Public Service of Ontario Act, 2006 and any regulations made under that Part, a public servant within the meaning of that Act.

Disqualification 

(2) A member of council of a municipality is disqualified from holding office if, at any time during the term of office of that member, he or she, 

1. e) ceases to be a Canadiancitizen;
2. f) is not a resident, the owner or tenant of land or the spouse of an owner or tenant of land in the municipality, in the case of a member of council of a local municipality, or in a lower-tier municipality within the upper-tier municipality, in the case of a member of council of an upper-tier municipality; or
3. g) would be prohibited under this or any other Act from voting in an election for the office of member of council of the municipality if an election was held at that time.

School Board Member Qualifications  

Section 219 of the Education Act, 1990 states: 

Qualification of Members 

219 . (1) A person is qualified to be elected as a member of a district school board or school authority if the person is qualified to vote for members of that district school board or that school authority and is resident in its area of jurisdiction. 

(2) A person who is qualified under subsection (1) to be elected as a member of a district school board or school authority is qualified to be elected as a member of that district school board or school authority for any geographic area in the district school board’s or school authority’s area of jurisdiction, regardless of which positions on that district school board or school authority the person may be qualified to vote for. 

Eligibility for re-election 

(3) A member of a district school board or school authority is eligible for re-election if otherwise qualified.    

Disqualification of School Board Members 

Section 219 of the Education Act, 1990 states: 

Disqualifications  

219. (4) Despite subsection (1), a person is not qualified to be elected or to act as a member of a district school board or school authority if the person is,
220. a) an employee of a district school board or schoolauthority;
221. b) the clerk or treasurer or deputy clerk or deputy treasurer of a municipality or an upper-tier municipality, all or part of which is included in the area of jurisdiction of the district school board or the schoolauthority;
222. c) a member of the Assembly or of the Senate or House of Commons of Canada; or
223. d) otherwiseineligible or disqualified under this or any other Act.

Note: An employee of any school board is ineligible to run for school board trustee. 

Leave of absence  

(5) Despite subsection (4), none of the following persons is ineligible to be a candidate for or to be elected as a member of a district school board or school authority if he or she takes an unpaid leave of absence, beginning no later than the day the person is nominated and ending on voting day: 

1. An employee of a district school board or school authority. 

1. The clerk, treasurer, deputy clerk or deputy treasurer of a municipality or upper-tier municipality, all or part of which is included in the area of jurisdiction of a district school board or school authority  

(5.1) Subsections 30 (2) to (7) of the Municipal Elections Act, 1996 apply with necessary modifications to an individual referred to in subsection (5). 

Qualification to act as a member  

(9) A person is not qualified to act as a member of a district school board or school authority if the person ceases to hold the qualifications required to be elected as a member of the district school board or the school authority. 

Person not to be candidate for more than one seat 

(10) No person shall run as a candidate for more than one seat on a district school board or school authority and any person who does so and is elected to hold one or more seats on the district school board or the school authority is not entitled to act as a member of the district school board or the school authority by reason of the election.
